ANSWER AND COUNTERCLAIM FOR DIVORCE WITHOUT CHILDREN

This is the form packet for people who want to file their own Answer and Counterclaim to a divorce in Gwinnett County and who do not have minor children together with their spouse.  If you do not want to also file a Counterclaim for divorce, you should not use this packet.  Instead, use the version called Answer for Divorce without Children.  If you and your spouse have minor children together, you should not use this form packet.  Instead, use the version called Answer and Counterclaim to Divorce with Children.

You must file the following documents with the Answer and Counterclaim:

Answer and Counterclaim (PDF)

Domestic Relations Financial Affidavit (PDF)

Mutual Restraining Order (LINK)

Certificate of Service (PDF)

Notice of Lis Pendens (PDF) (only if applicable)

Rule Nisi (PDF) (only if you want a hearing on temporary issues)
