Prime Care EMS Driver Charged with DUI in Fairburn Georgia Ambulance Crash

On November 12, 2021, Fairburn Police Department stated that a single vehicle motor vehicle accident occurred on W. Campbellton Street and that vehicle was an ambulance.

Their post on Facebook asked locals to avoid the area.

The Atlanta Journal Constitution confirmed that the vehicle was indeed an ambulance. Tragically, the patient being transported was killed in the crash.

According to AJC, Kevin McCovey, a 34 year old, was charged with “DUI, second-degree vehicular homicide, open container and failure to maintain lane”.

Pictures posted on Twitter showed a wrecker (tow truck) recovering an overturned Prime Care EMS ambulance from a ditch.

News reports claim the patient was Wilton Thomason Jr.

Wrongful Death Claims against Ambulance Drivers in Georgia

Loved ones of someone killed in a motor vehicle accident in Georgia should be aware of Georgia Auto Accident Law and also what are called Wrongful Death Claims. A Wrongful Death Claim allows surviving family members of the deceased to file a lawsuit on behalf of their loved one.

You should always speak to a licensed personal injury attorney after a fatal accident.

In an accident involving an ambulance, someone would need to prove that the driver was negligent. In this case, that would be the Prime Care EMS driver.

Even in an accident where a driver was clearly negligent, an insurer is likely to not inform you of a wrongful death claim. In some cases they even try to blame accident victims for their injury, or use their medical conditions to attempt to minimize payouts.

In a crash like this one there may be multiple defendants, such as the driver, the EMS company & their insurer.
